Court Ruling: Alcohol Beverage Control Board fines The Alpine Restaurant for Illegal Barking
Case Summary: As a result of the Defendant employees using the City Streets and sidewalks to illegally solicit patrons, the City brought an action to suspend the Alcohol Permit against “The Alpine Restaurant” for creating a public nuisance by operating the establishment contrary to municipal law. Specifically, on June 4, 2009, the doorman of the establishment was observed on the sidewalk soliciting individuals to patron the establishment, in violation of Municipal Code Ordinance 110-222. The establishment’s actions severely affected and negatively impacted the surrounding neighborhood’s quality of life. The City sought to suspend the establishment’s liquor license, for violations of the ordinance and the Alcohol Beverage Control Board’s Rules and Regulations concerning nuisances. After a full hearing before the Alcohol Beverage Control Board, the Board unanimously found in favor of the City, ordering the Defendant to pay a $500 fine for violating the solicitation law and a $600 fine for delinquent taxes.
