Court Ruling: Alcohol Beverage Control Board suspends Bus Stop Lounge’s liquor permit

Case Summary: As a result of a recent murder in the establishment, the City brought an action to suspend the Alcohol Permit against “Bus Stop Lounge” for violations of the provisos regarding hours of operation, level of security, and trash on the premises. Pursuant to a previous agreement reached on September 18, 2007, “Bust Stop Lounge” agreed to close their establishment at 2:00 am. on Friday and Saturday nights, and 12:00 a.m Sunday thru Thursday. They further agreed to clean-up around the establishment and to hire professionally accredited security personnel to patrol the area to prevent loitering, litter, vandalism and urination on neighbor’s property. The agreement also provided that any violation of any of the provisos of the agreement will result in a suspension of their Alcohol Beverage permit for 30 days. Moreover, on May 17, 2009, a shooting took place inside the premises of the establishment, wherein a patron was shot and killed. “Bus Stop Lounge” did not maintain any security on that day, and the weapon was permitted inside the establishment. The City sought to revoke the establishment’s license, for violations regarding the consent agreement and the shooting. After a full hearing before the Alcohol Beverage Control Board, the Board unanimously voted in favor of the City to suspend for 60 days the license of the Defendant, and to require them, under threat of revocation, to abide by the terms of the Consent Judgment.
